No se sabe qué delegaciones, cuántos, mucho menos quienes serán los beneficiados por la lista de intocables que el jefe de Gobierno promueve a través de reformas a la Ley de Procedimiento Administrativo del DF, publicadas por él mismo el pasado 7 de abril. De lo único que tenemos certeza, es que Marcelo Ebrard trabaja para todos, sus amigos claro, menos para la ciudadanía.

El jefe de Gobierno del DF envió el año pasado una iniciativa de reformas al a ley anteriormente mencionada. Estas reformas, entre otras cosas, buscan beneficiar a un puñado de empresarios y constructores que podrían quedar exentos de las verificaciones administrativas y de protección civil que diariamente se realizan en todo el Distrito Federal. La finalidad de dichas reformas, de acuerdo con la iniciativa enviada el año pasado por el propio jefe de gobierno, era la de facilitar la apertura de negocios en la capital.

Sin embargo, nos encontramos con todo lo contrario. Resulta que con total discrecionalidad, el jefe de gobierno podrá elaborar un listado de empresas (antros, bares, restaurantes) y de obras que quedarían fuera de la aplicación de la ley. Estas disposiciones propuestas por el jefe de gobierno y publicadas por él mismo, son autoritarias y con fondo totalmente electoral. Lo único que busca es condicionar a empresarios a cambio de prebendas con miras a los comicios electorales del 2012. Marcelo Ebrard no puede utilizar la ley para favorecer sus aspiraciones políticas, ni mucho menos para beneficiar a unos cuantos. La ley debe ser aplicada para todos sin distinción.

El Gobierno del DF no estaría en condiciones de elaborar un acuerdo de este tipo, cuando en 2008, se tenía el cálculo de que en el Distrito Federal existían alrededor de 28 mil establecimientos mercantiles. Al día de hoy no existe un padrón total de establecimientos, sin embargo, tan sólo en la Delegación Venustiano Carranza existen más de 15 mil. Además, no se ha establecido el mecanismo ni los requisitos con base en los cuales serán seleccionados los beneficiarios de dicho acuerdo, abriéndose de par en par puerta a la corrupción.

Establecimientos de alto impacto tanto en el ámbito urbano como en el ambiental y comercial podrían operar sin verificación alguna. De esta manera, se permitiría la operación de negocios como bares y centros nocturnos que no cuentan con los permisos y obras que garanticen la seguridad e integridad de los ciudadanos.

Incentivar la actividad económica en la Ciudad mediante la apertura de comercios no debe ser justificación para violar la ley o crear excepciones en la aplicación de la misma. No puede ser un argumento para privilegiar a algunos empresarios bajo criterios discrecionales que no toman en cuenta la opinión de los vecinos ni de las autoridades delegacionales. En suma, de no modificar la Ley de Procedimiento Administrativo, Marcelo Ebrard estará consintiendo violaciones e irregularidades en materias tan importantes como protección civil y preservación del medio ambiente en detrimento de los capitalinos.
