En junio de 2010 se dio a conocer la primera propuesta por parte de la Asociación Mexicana de Publicidad Exterior (AMPE) para la creación de un “nodo publicitario”, cuyo objetivo principal era ordenar la colocación de publicidad exterior para aminorar los problemas de contaminación del paisaje urbano que generan los miles de espectaculares y vallas que se encuentran sembrados por toda la ciudad de México.

Dicho nodo, de acuerdo con la propuesta inicial, habría de colocarse en la Glorieta de Insurgentes y sería el primero de una serie cambios a realizar en puntos estratégicos del Distrito Federal. Tras un año de presiones entre empresarios dedicados a la publicidad exterior y las autoridades del Gobierno del Distrito Federal, en especial de la Secretaría de Desarrollo Urbano y Vivienda, el pasado 14 de junio se llevó a cabo el sorteo para definir la asignación de los espacios para los anuncios que integrarán el primer nodo.

De tal sorteo lo único que salió por unanimidad fueron quejas de la mayoría de los representantes de las 15 empresas que presenciaron el evento, al constatar lo turbio del proceso al cual ni siquiera acudieron las autoridades encargadas del tema de desarrollo urbano en la capital.

La molestia surgió porque se definió que el 60 por ciento de los espacios quedaría en manos de tres empresas pertenecientes a la Asociación Mexicana de Publicidad Exterior, lo que generó un profundo descontento entre quienes veían dicho proyecto como una alternativa viable, seria y consensada para ordenar la publicidad exterior en el Distrito Federal.

El problema no es menor. El Gobierno del Distrito Federal puso el mal ejemplo al tratar de concretar un proyecto sumamente ambicioso basado en un gran vacío legal, ya que apenas hace unos meses la Asamblea Legislativa del Distrito Federal aprobó la Ley de Publicidad Exterior en la cual se deben establecer las bases para impulsar este tipo de proyectos. Al día de hoy, esta norma carece de reglamento.

Las cosas no pueden hacerse de atrás para adelante. Las autoridades del Distrito Federal debieron establecer las reglas del juego desde un inicio para posteriormente llevar a cabo este tipo de procesos administrativos conforme a la ley, otorgando certeza jurídica y administrativa a los participantes, y no mediante acuerdos que al final del día nadie cumple. Es lamentable que conforme pasan los meses y se acerca el fin de la administración de Marcelo Ebrard, las cosas sigan tan mal como al principio.
